    Are non standard parts illegal?

Last week a customer was stopped by traffic police and told that he would have to remove his dump valve and exhaust as they were too noisey and he would receive an ASBO if he never ALSO because they were non standard they were illegal!

The cop was at the time accompanied by another traffic cop that i have previously had a conversation on this subject with and at the time he said they were not illegal, but, now they are being told to ASBO them.

This cop builds hot rods for a hobby and fabricates exhauts from manifolds to silencers and is now saying what he does is not acceptable either!!!

I know that a noisey car cannot get an ASBO if it is under whatever db it should be BUT if you cause your car to make exsessive noise you can be ASBO'd for it.

What is the law on this?

probably anything they choose to move the goal posts to include , these 'ASBO's' seem to be given out basicaly because the police can't prove anything in law

The laws are whatever the attending officer makes up at the time i would imagine. The actual law is also irrelevant as any subsequent enquiries by yourself to follow up the situation to find out where you legally stand will fall on deaf ears.

The ASBO and noise thing relating to cars afaik still has to be fought in court for a ruling? but the modified parts may fall under type approval? Dunno?

type approval or (ESVA) only has to be met at time of testing,

take Misubishi with something like the L200 at time of testing it would never meet type approval with a bull bar or side steps fitted. yet go into a dealer and you see them fitted ready to be sold

    Thats true.

Im just wondering where they are comming from with this tho... i'm thinking they are acting above the law here.

I phoned Magnex on this and they said their products were fine for road use, perfectly legal.

Thing is the cops are ASBOing just about anything now.

Do you not get the chance to argue an issued ASBO in a court of law then?

If you have it valid mot i would find it hard to accept that my car is illegal based on a copper on the street , the more we challenge these actions the less they can use them

Nothing against coppers as my mate is one but he brings his car around for me to change the bulbs, he admits to knowing nothing about cars !!

    I agree.

If the car passes the MOT and you get pulled over for having "illegal" parts fitted, I think the Feds would need to re-value what is legal.

Kind of makes the MOT a waste of money if the Police can say what is legal or not.

    very true

coppers on the street often think they create the laws of the land rather than implement them

No wonder the public have lost confidence in the police

This subject now needs to go in the Ranting section lol

Go catch some real criminals etc, my exhaust isn't killing anyone (well, not directly, maybe the earth over a long time with my de-cat exhaust officer but thats a different story lol)

Maybe Ovais could clarify the law on exhaust systems and such like, or ask the question in his next training meeting.
